Terms of Service
Effective date: July 10, 2026
These terms govern your use of Formiary — the form backend service available
at www.formiary.com, app.formiary.com, and api.formiary.com. By creating
an account or using the service, you agree to them. If you're using Formiary
on behalf of a company or agency, you're agreeing on its behalf and confirm you
have the authority to do so.
The service
Formiary receives submissions from forms on your websites, validates them against the fields and rules you define, stores them, and routes them — notifications, auto-responses, webhooks, and integrations. We may improve or change features over time; we won't materially reduce the core functionality of a paid plan during a period you've already paid for.
Your account
You're responsible for your account, for keeping your credentials secure, and for everything done through it, including by team members you invite. Provide accurate account information and keep your email address current — it's how we reach you about billing, security, and service changes.
Your content and your responsibilities
You own the data your forms collect. You grant us the limited rights needed to operate the service — to receive, store, process, and route submissions on your instructions.
Because your forms collect data from other people, you're responsible for:
- having a lawful basis to collect it, and providing any required privacy notice on your own websites;
- what your forms collect — don't collect data you're not allowed to collect, and don't use Formiary for special categories of data (such as health or payment card data) that require safeguards we haven't agreed to in writing;
- responding to your submitters' requests about their data (we'll assist — see our Privacy Policy).
Acceptable use
Don't use Formiary to break the law or harm others. Among other things, you must not:
- collect data deceptively or without a lawful basis, or use the service for phishing;
- send or distribute spam, malware, or other harmful content, including via file-upload fields or auto-responses;
- attempt to probe, overload, or disrupt the service, or access another customer's data;
- resell the service itself (managing forms for your clients as an agency is what the service is for, and is fine).
We may suspend or terminate accounts that violate these terms, and will notify you when we do unless we're legally prevented from doing so.
Plans, billing, and overages
- Paid plans are billed in advance, monthly or yearly, via our payment processor. Prices and plan limits are listed on the pricing page.
- Overages: we don't drop submissions when you exceed your plan's monthly volume. On paid plans, extra submissions are billed automatically at the tiered per-1,000 rates shown on the pricing page. On the Free plan, submissions beyond the limit may not trigger extras such as notification emails and integrations.
- You can upgrade, downgrade, or cancel at any time from your account settings; changes take effect as described there. Refunds are available within 30 days of purchase — contact us.
- We may change prices with at least 30 days' notice; changes apply from your next billing period.
Service availability
We aim to keep Formiary available and reliable, but the service is provided "as is" and "as available", without warranties of any kind, express or implied. We may perform maintenance and will try to minimize disruption.
Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data. Our total liability arising out of the service is limited to the amounts you paid us in the twelve months before the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited by law.
Termination
You may close your account at any time. We may suspend or terminate your account for material breach of these terms, or with reasonable notice if we discontinue the service. On termination we'll make your data available for export for a reasonable period, after which it is deleted per our Privacy Policy.
Changes to these terms
We may update these terms from time to time. For material changes we'll give you notice by email or in the dashboard before they take effect; continuing to use the service after that means you accept the updated terms.
Governing law
These terms are governed by the laws of the jurisdiction in which Formiary is established, without regard to conflict-of-law rules, and disputes will be resolved in the courts of that jurisdiction.
